Terms and Conditions of the Custom Fazer Service

Please also refer to the general terms and conditions of use for Fazer's websites, which apply to the use of the Custom Fazer service and the website."

1.       General

1.1.           The Custom Fazer service is a food packaging design and ordering service (hereinafter "Service") provided by Fazer Makeiset Oy (hereinafter "Fazer").

1.2.           These terms and conditions include the terms of use of the Service as well as the terms of ordering and delivery. By registering for the Service or purchasing products from the Service, the user of the Service (hereinafter "Customer") accepts these terms and agrees to comply with them.

1.3.           The Service includes instructions that specify these terms. The Service is primarily intended for business and association customers. Private individuals can also use the Service, but only orders placed with a business ID can be invoiced. The minimum order quantity depends on the product.

2. Personal Data and Its Use

2.1. The personal and company data of Customers using the Service are collected and stored in a customer register maintained by Fazer. The use of personal data is described in Fazer's privacy policy. Personal data is mainly collected to implement the Service and deliver products.

2.2. The Customer has the right to check their personal data and request changes or complete removal from the register.

3. Order

3.1. Custom-designed products are ordered through the Custom Fazer service.

3.2.  The order becomes binding on Fazer once it has been separately confirmed by Fazer. Fazer reserves the right not to accept an order, for example, if the order is deemed inappropriate or if there is reason to doubt the Customer's creditworthiness. Fazer may exercise this right even after the order confirmation has been sent. Fazer will strive to inform the Customer as soon as possible if the order is rejected. The Customer does not have the right to cancel the order once production has started.

4. Product Prices

4.1. The current prices of the products are displayed on the Custom Fazer service pages and/or sent to customer in a quotation.

4.2. Delivery costs are added according to the chosen delivery method. Product prices and delivery costs include VAT at 14% for Finland. If the VAT rate is changed according to legislation or official guidelines, Fazer has the right to adjust the VAT to match the new rate from its effective date.

4.3. When products are sold and delivered outside of Finland, no taxes will be added to the order if the conditions for intra-community trade within the EU are met.

5. Payment

5.1. The Customer can pay in our online store using the most common online payment methods, such as bank payments and credit cards (Visa, Mastercard). Business orders can also be paid by invoice (a business ID is required).
In Finland all prices include VAT and the currency used is the euro.

5.2. For online payment methods, the payment service provider is Paytrail. Paytrail is a safe and easy payment method. When you choose "Pay online," you will be directed to the Paytrail payment wall, from where you will be redirected back to the Custom Fazer service after a successful payment.

Payment Service Provider

The payment intermediary service and payment service provider is Paytrail Oyj (2122839-7) in cooperation with Finnish banks and credit institutions. Paytrail Oyj appears as the recipient of the payment on the account statement or credit card bill and forwards the payment to the merchant. Paytrail Oyj has a payment institution license. In case of complaints, please contact the product supplier first.

5.3. When paying by invoice, the payment term is 14 days net. Interest on late payments is charged according to the Interest Act.

6. Delivery

6.1. Orders are processed and printed within 2 weeks from the next business day after the order confirmation, after which the ordered products are handed over to the carrier for delivery to the delivery address provided by the Customer.

6.2. Custom Fazer products are printed, packaged, and shipped to our partner's warehouse in Inkeroinen, Finland, from where they are delivered to the Customer. Products are delivered to the delivery address provided by the Customer.

6.3. The Customer is responsible for the accuracy of the delivery address. The delivery time is approximately 2-3 weeks from the next business day after the order confirmation. Fazer will do its best to meet the estimated delivery time but is not responsible for delays.

6.4. Products always have at least 3 months left until the best before date from the time of delivery.

6.5. The delivery area is mainly mainland Finland. Deliveries to foreign countries (EU area) and deliveries to multiple locations are handled on a case-by-case basis. We do not deliver Custom Fazer products to Greece, Romania, Bulgaria, the Canary Islands, or Åland.

7. Complaints

7.1. Customers should check the delivery immediately upon receipt. If the Customer suspects that there is a defect in the product or that products are missing from the delivery, the Customer must submit complaints related to the deliveries to Fazer immediately or no later than 3 days after receiving the product. If a defect is found in the product, Fazer will correct the defect in the way it deems best by either i) delivering a defect-free or replacement product for the defective one, or ii) canceling the sale of the product in question and refunding the purchase price to the Customer.

7.2. The Customer does not have the right to complain about a product defect that is due to the poor quality of the image material uploaded by the Customer to the Service or in cases where Fazer has delivered the product according to the Customer's instructions to an address that does not meet the recommended conditions for the product's preservation (e.g., delivery of the product to a mailbox in summer). It is the Customer's responsibility to transfer the product to appropriate storage facilities as soon as possible after delivery.

8 Intellectual Property Rights

8.1. All rights to the content of the Service belong to Fazer or to Fazer Group companies. The material on the site (such as texts, images, logos, trademarks, and other protected material) is the property of Fazer or Fazer Group companies. Copying or using the materials without Fazer's permission is prohibited.

8.2. The Customer assures that the material or content provided for the product they designed does not violate good manners or third-party rights. The Customer is responsible to Fazer for all damages caused to Fazer by the material or content provided by the Customer or by it violating good manners or third-party rights. Fazer reserves the right not to accept or deliver an order for a justified reason, such as if the designed packaging is deemed inappropriate by Fazer.

9. Limitation of Liability

9.1. Fazer does not guarantee the uninterrupted operation of the Service. The Service is subject to the same limitations as the Internet in general, for example, simultaneous connections by users can congest the Service and affect its usability. Fazer is not responsible if the Customer's order does not reach Fazer due to network or communication failures. Fazer is not responsible for delays caused by force majeure. Additionally, Fazer is not responsible for errors occurring during transportation.

9.2. Fazer is not liable for indirect damages. Fazer's liability is limited in all cases to the value of the defective/delayed/missing products.

10. Applicable Law and Dispute Resolution

Any disputes between the Customer and Fazer will be governed by Finnish law and resolved in the Helsinki District Court.
